Terms of Service

Welcome to burnt.com, a site (the "Site") provided by the Inferno Research Foundation, which together with all of Inferno Research Foundation's respective officers, directors, employees, contractors, consultants, agents, subsidiaries, affiliates, predecessors, and successors are collectively referred to in these Terms of Service hereafter as "we", "our", or "us".

The Site and related services (including truth.burnt.com) provide: (a) access to the Xion Blockchain ("Xion") for users who want to interact with Xion for purposes including, but not limited to, participating in governance, staking, and bridging assets; and (b) instant data verification infrastructure ("Truth") that enables businesses and individuals to verify user-provided data directly from the source using privacy-preserving cryptographic methods.

By accessing or using the Site, you signify that you have read, understand, and agree to be bound by this Agreement in its entirety. If you do not agree, you are not authorized to access or use the Site.

1. Modification of this Agreement

We reserve the right, in our sole discretion, to modify this Agreement from time to time. If we make any modifications, we will notify you by updating the date at the top of the Agreement. All modifications will be effective when they are posted, and your continued use of the Site will serve as confirmation of your acceptance of those modifications.

2. Eligibility

To access or use the Site, you must be able to form a legally binding contract with us. You represent that you are at least eighteen years old and have the full right, power, and authority to enter into and comply with the terms of this Agreement. You further represent that you are not a citizen, resident, or member of any jurisdiction or group that is subject to sanctions by the United States (OFAC), or where your use of the Site would be illegal or otherwise violate any applicable law.

3. Account Registration and Third-Party Authentication

You may create an account on the Site by registering directly or by authenticating through a third-party provider such as Google, Apple, or other OAuth 2.0-based services ("Third-Party Login"). When you use a Third-Party Login:

  • You authorize us to access and use certain information from your third-party account as permitted by that provider and as described in our Privacy Policy.
  • You are responsible for maintaining the security of your third-party account credentials. We are not liable for any loss or damage arising from unauthorized access to your third-party account.
  • You may disconnect your third-party account at any time through that provider's settings.
  • Your use of any Third-Party Login is also subject to that provider's own terms of service and privacy policy.

4. Google Account Data Access for Verification

With your explicit consent, our service may request access to data within your Google account, including email data, to perform a specific verification check. By granting this access, you acknowledge and agree that:

  • Access is requested only through Google's standard OAuth consent flow.
  • We access your Google data solely to determine a specific fact relevant to the verification you have requested. We process this data only in memory and derive only a "Yes" or "No" verification result.
  • We do not read, store, log, cache, index, or retain any raw email content, message bodies, attachments, headers, or metadata.
  • Only the verification result is retained as a record that the verification occurred.
  • You may revoke our access at any time through your Google Account permissions page.

5. Use of the Truth Verification Service

When using the Truth verification service (whether through Google account data or other sources), you acknowledge and agree that:

  • You will only verify data from accounts that you own or are authorized to access.
  • For non-Google verifications, you log in to your own third-party account through a client-side secure session that runs entirely within your browser. Our servers never see, intercept, access, or store your login credentials.
  • The verification process uses cryptographic methods, including Zero-Knowledge Proofs (ZKPs), to extract and verify specific facts without exposing your raw personal data to the requesting party.
  • The requesting party will receive only a verified confirmation of the specific fact being verified, not your underlying personal data.
  • We are not responsible for the availability, accuracy, or security of third-party services that you access during the verification process.

6. Privacy

We care about your privacy. Our collection, use, and disclosure of your personal information is governed by our Privacy Policy, which is incorporated into this Agreement by reference.

7. Prohibited Activity

You agree not to engage in any of the following prohibited activities:

  • Intellectual Property Infringement. Activity that infringes on or violates any copyright, trademark, service mark, patent, right of publicity, right of privacy, or other proprietary rights.
  • Cyberattack. Activity that seeks to interfere with or compromise the integrity, security, or proper functioning of any computer, server, network, or information technology system.
  • Fraud and Misrepresentation. Activity that seeks to defraud any person or entity, including providing false or misleading information to unlawfully obtain the property of another.
  • Unauthorized Account Access. Accessing or attempting to access another user's account, or using another person's third-party authentication credentials without their authorization.
  • Verification Fraud. Attempting to manipulate, falsify, or circumvent the verification process, including by using accounts you do not own, tampering with cryptographic proofs, or misrepresenting verified data.
  • Any Other Unlawful Conduct. Activity that violates any applicable law, rule, or regulation.

8. No Professional Advice

All information provided by the Site is for informational purposes only and should not be construed as professional advice. Before you make any financial, legal, or other decisions involving the Site, you should seek independent professional advice.

9. No Warranties

The Site is provided on an "AS IS" and "AS AVAILABLE" basis. To the fullest extent permitted by law, we disclaim any representations and warranties of any kind, whether express, implied, or statutory. You acknowledge and agree that your use of the Site is at your own risk.

10. No Fiduciary Duties

This Agreement is not intended to, and does not, create or impose any fiduciary duties on us. You acknowledge and agree that the only duties and obligations that we owe you are those set out expressly in this Agreement.

11. Assumption of Risk

By accessing and using the Site, you represent that you understand the inherent risks associated with using cryptographic and blockchain-based systems. You agree to assume full responsibility for all of the risks of accessing and using the Site and interacting with Xion.

12. Third-Party Resources and Promotions

The Site may contain references or links to third-party resources, including third-party authentication providers and services accessed during verification flows. We do not endorse or assume any responsibility for any such resources. If you access any such resources, you do so at your own risk.

13. Release of Claims

You expressly agree that you assume all risks in connection with your access and use of the Site. You further expressly waive and release us from any and all liability, claims, causes of action, or damages arising from or in any way relating to your use of the Site.

14. Indemnity

You agree to hold harmless, release, defend, and indemnify us from and against all claims, damages, obligations, losses, liabilities, costs, and expenses arising from your access and use of the Site, your violation of any term of this Agreement, or any other party's access and use of the Site with your assistance.

15. Limitation of Liability

Under no circumstances shall we be liable to you for any indirect, punitive, incidental, special, consequential, or exemplary damages arising out of or relating to any access or use of the Site. This limitation of liability applies regardless of whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, and even if we have been advised of the possibility of such liability.

16. Account Termination and Suspension

We reserve the right to suspend or terminate your account and access to the Site at our sole discretion, without prior notice, for conduct that we determine violates this Agreement or is harmful to other users, us, or third parties.

17. Dispute Resolution

Any claim or controversy arising out of or relating to the Site or this Agreement shall be finally and exclusively settled by arbitration with JAMS pursuant to JAMS' Comprehensive Arbitration Rules and Procedures. The arbitration shall be held in Wilmington, Delaware unless both parties agree otherwise.

18. Class Action and Jury Trial Waiver

You must bring any and all disputes against us in your individual capacity and not as a plaintiff in or member of any purported class action, collective action, or other representative proceeding. You and we both agree to waive the right to demand a trial by jury.

19. Governing Law

You agree that the laws of the Cayman Islands, without regard to principles of conflict of laws, govern this Agreement and any dispute between you and us.
